Welcome to TripFreak. These Terms of Service ("Terms") govern your access to and use of TripFreak's website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

TripFreak is a flight price tracking and email notification service that allows users to:

• Set up flight price alerts based on specific routes, dates, and preferences
• Receive automated email notifications when flight prices match your criteria
• Track multiple destinations and travel dates simultaneously
• Filter results by airlines, price limits, and other preferences

The Service aggregates flight pricing data from third-party providers and delivers this information to you via email. We do not sell tickets, make reservations, or process flight bookings.

3. User Accounts

3.1 Account Registration

To use the Service, you must create an account by providing accurate and complete information. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account

3.2 Account Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.

3.3 Account Termination

You may delete your account at any time through the account settings page. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

5. Flight Price Information

5.1 Data Accuracy

Flight prices and availability are provided by third-party data providers and airlines. We make reasonable efforts to provide accurate information, but we do NOT guarantee:

• The accuracy, completeness, or timeliness of flight pricing data
• The availability of flights at the prices displayed
• That prices will remain the same when you book
• That all flights or airlines are included in search results

5.2 No Booking Guarantee

TripFreak is an information service only. We do not:

• Sell airline tickets or make flight reservations
• Guarantee that you can book flights at the prices shown
• Process payments or handle bookings on your behalf
• Act as a travel agent or booking platform

You are responsible for verifying prices and booking flights directly with airlines or authorized travel agencies.

5.3 Cache and Data Updates

Flight search results may be cached for up to 7 days to improve performance. Cached data may not reflect real-time prices. We update our data regularly, but prices can change frequently and without notice.

6. Email Notifications

By using the Service, you consent to receive:

• Flight price alert emails based on your configured preferences
• Service-related notifications and updates
• Important account and security notifications

You can manage your email preferences and unsubscribe from flight alerts at any time by updating your account settings or deleting specific alerts.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by TripFreak and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. This license does not include:

• Resale or commercial use of the Service
• Collection and use of flight data for competing services
• Derivative works based on the Service
• Downloading or copying of account information for the benefit of another merchant

7.3 Third-Party Data

Flight pricing data is provided by third-party sources and may be subject to their own intellectual property rights and terms of use.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or availability of the Service
• Warranties that the Service will be uninterrupted, timely, secure, or error-free

We do not warrant that defects will be corrected, or that the Service is free of viruses or other harmful components. Your use of the Service is at your sole risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPFREAK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or loss of opportunity
• Damages arising from errors or inaccuracies in flight pricing information
• Damages arising from your inability to use the Service
• Damages arising from unauthorized access to your account or data
• Damages arising from third-party services or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless TripFreak and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

The Service may contain links to third-party websites, services, or resources. We provide these links for your convenience, but we do not:

• Endorse or assume responsibility for third-party content or services
• Control or monitor third-party websites
• Guarantee the accuracy or safety of third-party resources

14.3 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in Seoul, Republic of Korea.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TripFreak regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or failures of third-party services.
